1. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Muhammad ibn ‘Abd Allah ibn Hilal from ‘Uqbah ibn Khalid who said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who comes to the land of another man and cultivates it without the permission of the owner until it is time of harvests; and the owner comes and says, ‘You have cultivated my land without my permission so your plantation belongs to me and I owe what you have spent’; if he is right. He (the Imam) said, ‘Plantation belongs to the farmer and the owner of the land deserves to receive the rent for his land.’”
IsnādMuhammad ibn Yahya, de Muhammad ibn al-Husayn, de Muhammad ibn Abdullah ibn Hilal, d'Uqbah ibn Khalid, a dit: J'ai interrogé Abou Abdullah (sur lui soit la paix) au sujet d'un homme qui cultive la terre d'un autre sans sa permission, jusqu'à ce que les cultures arrivent à maturité. Le propriétaire de la terre vient alors et lui dit: Tu as cultivé sans ma permission, donc ta culture est pour moi et ce que tu as dépensé est pour toi. Est-ce cela ou non? Il répondit: La culture est pour le cultivateur et le propriétaire de la terre doit lui payer le loyer de sa terre.
