Les Bijoux et Ornements ne Sont pas Soumis à la Zakat

3. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Safwan ibn Yahya from Ya’qub ibn Shu’ayb who has said the following: “I once asked abu ‘Abd Allah, ‘Alayhi al-Salam, if there is Zakat on jewelries. He (the Imam) said, ‘If so nothing will remain thereof.’”

Lorsqu'on demande à l'Imam Sadiq (sur lui la paix) si les bijoux doivent être purifiés, sa réponse est que s'ils sont purifiés, il ne reste rien de leur impureté.

4. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Rifa’ah who has said the following: “I once heard abu ‘Abd Allah, ‘Alayhi al-Salam, say, when certain people asked him if there is Zakat on jewelries, ‘Zakat is not due on jewelries even if it becomes a hundred thousand.’”

`Je n'ai pas besoin de zakat sur mes bijoux, même s'ils atteignent cent mille.`

5. A number of our people have narrated from Ahmad ibn Muhammad ibn ’Isa from al-Hassan Ali ibn Yaqtin from his brother al- Husayn from Ali ibn Yaqtin who has said the following: “I once asked abu al-Hassan, ‘Alayhi al-Salam, about goods which are not used or moved. He (the Imam) said, ‘There is Zakat on it every year until it is used.”

La zakat doit en être payée chaque année, sauf s'il est gaspillé.

6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn abu ‘Umayr from certain persons of our people who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Zakat of jewelries is allowing others to borrow it.’”

La zakat des bijoux est due sur ce qui est porté.

7. Ali ibn Ibrahim has narrated from his father from Hammad ibn ’Isa from Hariz from Harun ibn Kharijah who has said the following: “I once said to abu ‘Abd Allah, ‘Alayhi al-Salam, that my brother, Yusuf accepts employment from these people from which he has earned great amounts of wealth and has turned them into jewelries to avoid Zakat. Is there Zakat on it? He (the Imam) said, ‘Zakat is not due on jewelries; however, the loss that he has caused to himself in this way and depriving himself of the virtue of paying Zakat is greater than his fear of paying Zakat.”

Le Prophète (que la paix soit sur lui) a expliqué qu'il n'est pas obligatoire de payer la Zakat sur les ornements et que la récompense pour la perte encourue en les gardant est plus grande que la crainte de la Zakat.

8. Hammad ibn ‘Isa has narrated from Hariz from Ali ibn Yaqtin who has said the following: “I once said to abu Ibrahim, ‘Alayhi al-Salam, certain things accumulate with me and remain for about a year. Is there Zakat on it? He (the Imam) said, ‘No, Zakat is not due on it. Use whatever is with you until one is passed, Zakat is not due on it and whatever is not rika’z you do not owe anything therefor.’ I then asked, ‘What is rika’z? He (the Imam) said, ‘It is solid with designs on it.’ He (the Imam) then said, ‘If you like you can cast them because Zakat is not due on alloys of silver and gold.”’

J'ai dit: "Il se rassemble chez moi quelque chose et reste environ une année, devrais-je le purifier?" Il a dit: "Non, tant que le cycle n'a pas tourné sur lui chez toi, il n'y a pas d'aumône à payer pour lui. Et tout ce qui n'est pas un trésor, tu n'as rien à en faire." J'ai dit: "Et qu'est-ce qu'un trésor?" Il a dit: "Le silencieux marqué. Puis il a dit: Si tu veux cela, fais-le fondre, car il n'y a rien de l'aumône dans tes bijoux en or et en argent."

9. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn Hadid from Jamil from certain persons of our people who have said the following: “Zakat is not due on gold. Zakat becomes due only on dinars and dirhams.”

Il n'y a pas de zakat dans le blé, elle est seulement due sur les dinars et les dirhams.

10. Ali ibn Ibrahim has narrated from his father from Hammad from ibn ’Udhaynah from Zurarah Bukayr who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘Zakat is not due on gems even if it becomes a large amount.’”

قَالَ لَيْسَ فِي الْجَوْهَرِ وَأَشْبَاهِهِ زَكَاةٌ وَإِنْ كَثُرَ.
